Terms of use

01 General provisions

These Terms of Use govern the relationship between creator and users of the platform.

By using the service, registering on the platform or uploading content, the user confirms full and unconditional acceptance of these Terms of Use.

creator is a digital platform that provides technical services for delivering music content to digital streaming services.

creator is not the author, rights holder or creator of works uploaded by users.

The platform acts as an information intermediary under Article 1253.1 of the Civil Code of the Russian Federation.

The service is available to persons aged 18 or over who have full legal capacity. Minors may use the service only with the consent of a parent or legal representative.

creator may record and retain information about users’ actions on the platform, including their registration date, IP address, email address, device specifications and other data confirming use of the service.

02 Registration and accounts

Users must complete registration to use the service.

When registering, the user agrees to:

• provide accurate and current information
• not share account credentials with third parties
• notify the service of unauthorized access to the account
• use only one account

The user is fully responsible for all actions performed through their account.

creator may suspend or block a user’s account without prior notice for a breach of these Terms of Use.

03 Uploading content

By uploading content to the platform, the user confirms that:

• they hold the rights to the uploaded content or have the necessary rights and licenses
• publishing the content does not infringe third-party rights
• the content meets streaming platforms’ requirements
• the content meets the service’s technical requirements

Technical requirements:

• Audio files: WAV, MP3, FLAC, OGG, AAC, M4A, CAF (maximum 300 MB per file)
• Cover art: JPEG, PNG or WebP, at least 3000×3000 pixels

Links, URLs and advertising materials are prohibited on cover art.

creator may refuse to publish content that does not meet technical requirements or streaming platforms’ rules.

04 Content rights

By uploading materials to the platform, the user grants creator a nonexclusive license to deliver them to distributors and streaming services for publication and distribution.

This license remains in effect until the release is removed or its distribution ends.

The user warrants that they hold all necessary rights to the musical work, lyrics, sound recording, performance and other elements of the work.

05 Prohibited content

Users may not upload content that:

• infringes copyright or related rights
• incites violence
• contains discrimination or incitement to hatred
• violates the laws of the Russian Federation
• contains third parties’ personal data without their consent
• constitutes spam or unlawful advertising

creator may remove such content without prior notice to the user.

06 Distribution

creator arranges delivery of content to streaming platforms.

Internal review usually takes up to 2–3 business days. After delivery, each streaming platform determines its review and publication timeline. We recommend uploading materials at least 5–7 days before your target date.

creator does not guarantee publication on every platform. Streaming services make publication decisions independently.

07 Payouts and accounting

The user’s earnings are based on reports received from streaming platforms. Payout amounts are determined solely by those reports.

creator is not responsible for the accuracy, correctness or completeness of reports provided by streaming platforms.

If a rights holder or streaming service makes a claim, creator may temporarily suspend payouts to the user until the dispute is fully resolved.

If the user does not request payment of accrued funds within three years of accrual, those funds may be deemed unclaimed.

08 Liability

The user is fully responsible for the content they publish.

The user agrees to reimburse creator for any losses, expenses, fines, compensation and legal costs resulting from:

• a breach of these terms
• an infringement of third-party rights
• uploading content without the necessary rights

creator is not responsible for:

• delays in publishing content
• a streaming platform’s refusal to publish content
• removal of content by platforms
• changes to recommendation algorithms
• changes to monetization terms

Under all circumstances, creator’s total liability is limited to the amount actually received from the user during the preceding 12 months of service use.

09 Changes to these terms

creator may change these Terms of Use at any time.

Updated terms are published on the platform. creator notifies users of material changes by email; such changes take effect 30 days after publication. Continued use of the service after the changes take effect constitutes acceptance of the updated terms.

10 Payments and refunds

Subscription payments cover the selected period of 1 or 12 months, depending on the plan option chosen. The subscription period begins when payment is received.

When paying by bank card, the user may enable subscription auto-renewal: the fee for the next period is charged to the saved card one day before the paid period ends, with an advance email notice approximately 3 days beforehand. Auto-renewal can be disabled at any time in the dashboard’s Profile section. Detailed terms appear in the Public Offer Agreement (section 04).

Refunds are available only in the following cases:

• payment was completed, but access to the account was not provided due to a technical issue
• the payment was charged twice

As a rule, no refund is issued if:

• the subscription has been activated
• access to the account has been provided
• a release has been submitted for review
• a release has been published on streaming platforms
• the account has been blocked for a breach of the terms

In individual cases, creator may issue a full or partial refund at its discretion, for example for an accidental plan payment when the service has not actually been used.

If an account is blocked, all active releases may be removed from streaming platforms within 30 days.

Refund requests must be sent to team@creatormusic.ru within 14 days of payment.

11 Final provisions

These Terms of Use do not create a partnership, joint venture, agency or employment relationship between the user and creator.

The parties recognize the legal effect of the user’s electronic actions on the platform, including registration, content uploads and acceptance of terms, as equivalent to a handwritten signature.

If these terms are translated into other languages, the Russian version prevails.

All disputes arising from use of the service shall be considered in accordance with the laws of the Russian Federation.
